    By accessing or using RealtyFlux services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

    2. Description of Service

    RealtyFlux provides ListingLive™ Engine-powered video creation services for real estate professionals. Our platform transforms property photos into engaging promotional videos with automated narration, music, and visual effects.

    RealtyFlux's ListingLive™ Engine utilizes advanced generative image and voice models to enhance and animate property photos. Due to the generative nature of this technology, the resulting videos may contain visual artifacts, inaccuracies, or alterations to the original property representation (including but not limited to virtual staging, lighting enhancements, or structural misrepresentations). RealtyFlux does not guarantee the factual accuracy of the generated videos.

    3. User Accounts

    When creating an account, you agree to:

    • Provide accurate and complete information
    • Maintain the security of your account credentials
    • Notify us immediately of any unauthorized access
    • Be responsible for all activities under your account

    4. Content Ownership & Usage

    You retain ownership of all images and content you upload. By using our service, you grant RealtyFlux a limited license to process your content solely for the purpose of creating your videos. Generated videos are owned by you upon full payment.

    If you utilize our Digital Staging & Decluttering features, you acknowledge that the resulting media is a digitally altered representation of the property. It is your responsibility to disclose to potential buyers or on MLS platforms that the media contains virtually staged or digitally enhanced elements, as required by your local real estate commission.

    By using our service and generating a video, you grant RealtyFlux a non-exclusive, royalty-free, worldwide license to display the final generated video on our website, social media channels, and marketing materials as part of our portfolio, unless you explicitly request to opt-out in writing.

    5. Acceptable Use

    You agree not to:

    • Upload content that infringes on others' intellectual property rights
    • Use the service for illegal or fraudulent purposes
    • Attempt to reverse engineer or copy our ListingLive™ Engine technology
    • Resell or redistribute our services without authorization
    • Upload inappropriate, offensive, or misleading content

    5.1 User Responsibility for Marketing Compliance

    You, the User, are solely responsible for ensuring that all videos, images, and scripts generated by RealtyFlux comply with all local, state, and federal real estate advertising laws, including the Fair Housing Act, MLS regulations, and your specific brokerage guidelines. You agree to review all generated content for accuracy before publishing or distributing it to the public. RealtyFlux shall not be held liable for any claims of false advertising, misrepresentation of property features, or regulatory fines incurred by your use of our generated content.

    6. Payment Terms

    All payments are processed securely through our payment providers. Prices are subject to change with notice. Subscriptions will auto-renew unless cancelled before the renewal date.

    7. Limitation of Liability and Indemnification

    To the maximum extent permitted by law, RealtyFlux and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, lost real estate commissions, loss of data, or reputational damage arising from your use of the service.

    You agree to indemnify, defend, and hold harmless RealtyFlux from any claims, lawsuits, damages, or expenses (including attorney's fees) brought by third parties (including property buyers, sellers, or regulatory bodies) resulting from your use, publication, or distribution of the videos generated by our platform.

    8. Termination

    We reserve the right to suspend or terminate accounts that violate these terms. You may cancel your account at any time through your account settings.

    9. Changes to Terms

    We may update these terms periodically. Continued use of our services after changes constitutes acceptance of the new terms.
